1.분쟁광물 이란?

(What is conflict minerals?)

콩고민주공화국 또는 그 인접국가 등 분쟁이 발생하고 있는 국가에서 생산되는 주석, 탄탈륨, 텅스텐,및 금 등의 광물을 지칭합니다. 분쟁광물로 인해 창출된 자금이 해당 국가 내 무장 세력으로 유입되어 자국민을 학살할 뿐만 아니라 채굴과정에서 발생할 수 있는 아동 및 강제 노동, 여성 학대 등 인권이 유린되고 있습니다. 이에 대하여 국제적 우려가 높아지는 가운데, 미 의회는 2010년 분쟁광물 사용에 대한 보고를 의무화한 법률(도드–프랭크 금융규제개혁법안 )을 제정하였으며, 상기 법안 1502조에 따라 미국 주식시장에 상장된 기업은 분쟁광물 사용 여부 및 원산지를 조사하고, 공급사슬에 대한 실사를 수행하여 그 결과를 미국 증권거래위원회(U.S.
Securities and Exchange Commission, SEC)에 보고하여야 합니다.

1. What is conflict minerals?
It refers to minerals, such as tin, tantalum, tungsten, and gold, produced in
disputed countries, such as the Democratic Republic of Congo or its neighboring
countries. Human rights are violated, including the extraction of children,
forced labor and women as well as capital generated from conflict minerals
which is drawn into the armed forces of the country. Amid growing international
concern, Congress enacted the Act on the Supply of Conflict Minerals in 2010
(the Dodd-Frank Financial Regulatory Reform Act), which imposed a report on the
use of conflict minerals (the U.S. Securities Deliveration Act) and the

당사는 다양한 공급사를 명확히 파악하기 위해 강한 실사체계와
OECD의 due diligence practices에 근거한 효과적이고 포괄적인 관리체계를 유지하여 본 정책을 이행한다. 이에 따라 당사는 아래 사항을 철저히 이행하고 있습니다.

1. 당사는 아래의 항목에 대해 용인하거나 이로부터 이익을 취하지 않을 것이며, 기여하거나 촉진시키지 않을 것입니다

강요, 강제 노역

아동 학대

·        
자유의 침해

·        
인권 침해, 인권 남용

·        
전쟁 범죄, 국제 인도주의 법률 위반, 인류에 대한 범죄, 집단 학살

2. 당사는 공급사가 위에 1번에 언급된 항목들 또는 기타 불법적인 항목들과 관련있는 상대방과 거래하고 있다는 가능성에 대해 상당한 위험을 발견한 경우 해당 공급사와 거래를 하지 않을 것이며, 기존에 거래하던 공급사인 경우 거래를 중단할 것입니다.

3. 당사는 반정부 무장단체 혹은 그들의 관계사에게 광물 구매, 대금 지급 혹은 기타의 장비 지원 등 직∙간접적인 지원을 제공하는 것을 용인하지 않을 것입니다. 반정부 무장단체 혹은 그들의 관계사는 불법적으로 광산과 수송 경로, 광물을 점거하여 유통하며, 세금을 부과하고 금품과 광물을 갈취하는 단체 등을 의미합니다.

4. 당사는 위의 3번에 기술된 바와 같이 반정부 무장단체에 대하여 직∙간접적인 지원을 제공하는 상대방과 거래하고 있다는 가능성에 대해 상당한 위험을 발견한 경우 해당 공급사와 거래를 하지 않을 것이며, 기존에 거래하던 공급사인 경우 거래를 중단할 것입니다.

5. 당사는 국가 공무원, 고객, 공급자 또는 다른 기관 등에 어떠한 형태로도 뇌물이나 리베이트를 제안하거나, 주거나, 약속하거나, 제공하지 않을 것입니다.

6. 당사는 금 수출, 운반, 보관, 무역, 채굴의 목적으로 정부에게 지불하는 로열티, 수수료, 세금을 왜곡하지 않을 것이며, 귀금속의 출처를 왜곡하지 않을 것입니다.

7. 당사는 귀금속의 공급 및 유통과 관련되거나 이에 기인한 테러자금 조달과 자금세탁의 상당한 위험성이 확인되는 경우에 테러자금 조달과 자금세탁을 예방하고 공개하는 데에 기여하고 이러한 노력을 지지할 것입니다.

8. 당사는 내∙외부 이해관계자들이 공급사슬 정책에 위배된다고 판단되는 관계 및 거래를 발견한 경우 경영자 및 관리책임자에게 보고할 수 있도록 매년 교육을 수행할 것입니다. 또한 내∙외부 이해관계자들에게 공급사슬 정책을 준수하도록 요구할 것이며, 이를 준수하지 않을 경우 계약 혹은 고용관계의 해지 등을 포함한 적절한 조치를 취할 것입니다.

The Company maintains an effective
and comprehensive management system based on the OECD dual digital interface
programs and a strong audit system to clearly identify the various suppliers.
As a result, the Company implements the following items thoroughly :

1. The Company will neither accept
nor profit from the following items, nor contribute or promote them :

Torture, abuse, human rights abuses,

Forced labor

Child abuse

An invasion of liberty

Human rights abuses

War crimes, violations of
international humanitarian law, crimes against humanity, genocide.

2. If the supplier is not trading
with any of the items mentioned above or any other items that are illegal, we
will find a substantial risk in the event of an interruption to the transaction
by the Supplier.

3.We will not permit anti-government
armed groups or their affiliates to provide direct or indirect support, such as
purchasing minerals, paying, or other equipment support. Indictable militant
groups or their affiliates refer to organizations that illegally distribute
mines and transport routes and minerals, impose taxes, and rob people of money
and minerals.

4. We have identified a substantial
risk in the event of a failure to deal with the parties providing direct and
indirect support to the anti – armed groups as described in the above 3.

5. We will not offer, offer, promise
or offer kickbacks in any form to government employees, customers, suppliers or
other institutions.

6. We will not distort or distort the
royalty, fees, or taxes paid to the Government for the purpose of gold export,
transportation, storage, commerce, or mining, and we will not distort the
sources of jewelry.

7.We are committed to preventing and
disclosing such financing and money laundering when such significant risks have
been identified in the procurement and distribution of jewelry and the
accompanying financing and laundering.

8. The Company will provide annual
training so that internal and external stakeholders can report any
relationships and transactions they find to be in violation of the supply chain
policies to the management and management managers. We will also ask our
internal and external stakeholders to comply with the supply chain policies, or
take appropriate actions, including termination of contracts or employment
relations.
